‘Submissions’ - referring to Your Submission; collectively, any question, comment, suggestion, idea, feedback, or other information about the services.
‘Contributions’ - referring to User-Generated Contributions and User Data; collectively, including but not limited to, the happistuff huddle via the “Chirps & Honks” submission form, happistuff Conscious Navigation, the happistuff Shop, Just Yours, the happistuff Oracle, and our general Contact Form.

We own and operate the website http://www.happistuff.com (the ‘Website’) and any other products and services (collectively as the ‘Services’) that relate, refer, or link to these Terms and Conditions (the ‘Terms and Conditions’).
By accessing and using this Website and Services, whether personally or on behalf of an entity (‘you’), you agree to be bound by the terms and conditions set out below. If you do not agree with any of these terms, please cease using the Website immediately.
This Website requires users to be at least 18 years old. By using this Website and accepting these terms, you confirm that you are at least 18 years of age.
Our Website uses cookies; by using our Website and, therefore, agreeing to these Terms and Conditions, you consent to our use of cookies as described in our Privacy Policy, available here: www.happistuff.com/privacypolicy.
We intend to keep the Services and Content current, relevant, and up-to-date. With this in mind, we reserve the right, at our sole discretion and without notice, to change, modify, or remove the contents of the Services at any time or for any reason.
We also reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Services at any time and for any reason without prior notice to you, and we will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.
Our Services may be upgraded or changed at any time, and we cannot guarantee that they will always be available.
Maintenance to the Services may be required at times, which may result in restrictions, interruptions, delays, or errors. We will make every effort, where possible, to ensure that any maintenance of the Services that causes such restrictions, interruptions, delays, or errors is performed at a time when the majority of users’ usage is least impacted.
You agree that we will have no liability for any loss, damage, or inconvenience resulting from your inability to access or use the Services during any downtime or discontinuance of the Services.
Nothing in these Terms and Conditions obligates us to maintain and support the Services, or to provide any corrections, updates, or releases in connection with them.
We reserve the right to amend these Terms and Conditions at any time. The modified Terms and Conditions will take effect once they are posted or you are notified by email from you@happistuff.com (whichever comes first). You agree to the modified Terms and Conditions by continuing to use the Services after the effective date of any modifications. Please check the latest revision and date at the beginning of the Terms and Conditions.
We are the owner or licensee of all intellectual property rights in our Services, including, but not limited to, all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively referred to as the ‘Content’).
We are the owner or the licensee of all trademarks, service marks, and logos contained within the Content and Services (collectively referred to as the ‘Marks’).
The Content and Marks are protected by trademark and copyright laws, and all Content and Marks are provided for your personal and non-commercial use only.
Unless expressly stated otherwise in these Terms and Conditions or with our express prior written permission, copying, modifying, reproducing by any means, in whole or in part, republishing, uploading, publicly displaying, distributing, selling, licensing, or otherwise exploiting any part of the Services, Content, or Marks for any commercial purpose is strictly prohibited.
If you would like to use the Services, Content, or Marks other than as set out in these Terms and Conditions, please submit your request to you@happistuff.com.
By submitting or sending us any question, comment, suggestion, idea, feedback, or other information about the services (collectively referred to as ‘Submissions’), you agree to assign us all intellectual property rights in and to such submissions.
By submitting or sending any Submission to us, you;
(a) Warrant that any such Submission is original to you or that you have the necessary rights and licenses to submit such Submissions and that you have full authority to grant us the above-mentioned rights in relation to your Submissions;
(b) You have read and agreed with our ‘Prohibitions’ and that your submission will not constitute, contain, or include anything illegal, hateful, harassing, harmful, defamatory, obscene, bullying, abusive, discriminatory, threatening, sexually explicit, inaccurate, deceitful, misleading, or confidential information.
You are solely responsible for your Submissions, and you expressly agree to reimburse us for any losses that we may suffer because of your breach of:
(a) This section;
(b) Any third party’s intellectual property rights;
(c) Applicable law.
By using or registering with our Services, you agree and adhere:
(a) All information you submit is true, accurate, current, and complete;
(b) You will ensure the accuracy of such information and promptly update it when necessary.
(c) You have the legal capacity and agree to comply with these Terms and Conditions;
(d) You are 18 years of age or older;
(e) You will not access the Services through automated or non-human means, whether through a bot, script, or unauthorised purpose;
(f) Your use of the Services will not violate any applicable law or regulation.
You are solely responsible for keeping your password(s) confidential and will be responsible for all use of your account(s) and password(s).
If any information provided by you is found to be: untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any current or future use, in whole or in part, of the Services.
We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.
Every endeavour is made to accurately depict the colours, features, specifications, and details of our Services’ products. However, we cannot guarantee the colours, features, specifications, and details of our Services’ products will be accurate, complete, reliable, current, or error-free, and that your electronic display will accurately reflect the actual colours and details of the products.
All products are subject to availability, and we cannot guarantee that the items will be in stock.
We reserve the right to discontinue or change the price of any products at any time for any reason.
Limited editions and series are a key element of our Services’ products, along with any resulting mismatches, changes, alterations, re-designs, including but not limited to colour, illustrations, copy, layout, size, features, and any other specifications and creative elements. We will endeavour to provide notice via the Website when new editions and series are introduced, and previous editions and series become no longer available. However, we do not guarantee notice of, or the availability of, any limited editions or series. The latest editions and series of our Services’ products are intended to be offered alongside, as replacements, supplements, and in coordinated mix with previous editions and series, in part, to any extent, or fully.
Digital products, including but not limited to ePublications and eBooks, are non-transferable, can be used on multiple devices at your convenience, but are licensed only to you, and must not be shared with a third-party or uploaded to websites and/or file-sharing networks.
All promotions and offers are accompanied by their own Terms and Conditions that are clearly displayed in the happistuff Shop and at the point of purchase.
You must be 18 years of age or older to have a Conscious Navigation session; if you are younger, you are not permitted to book or undertake a session.
Conscious Navigation sessions are only available online and are priced at £285.00 per session.
Sessions are held via Zoom; a link will be emailed after you complete your booking. Sessions last approximately 60-70 minutes, and while not strictly time-bound, the maximum duration for any session is 90 minutes.
Sessions can be booked online 30 days in advance and rescheduled online up to 7 days prior, subject to availability. Sessions cannot be booked with less than 24 hours' notice.
Please note: Cancellations made with less than 48 hours' notice are non-refundable. For all other cancellations, a £15.00 fee applies. If you need to cancel your Conscious Navigation session, contact us via email.
In the unlikely event we need to cancel your session for any reason, you will be contacted and offered a reschedule or a full refund; the £15.00 cancellation fee will not apply in this case.
If you are delayed for the start of a booked online Conscious Navigation session, we will typically wait 15 minutes, after which your session will be considered cancelled and non-refundable.
The focus of the sessions is on you supporting yourself to optimise your happiness and wellbeing in pondering the attributes of increased perspective, expanding perception, independent thinking, and self-appreciation. An open mindset and commitment to holistic self-enhancement, to whatever extent, will ensure maximum value is gained from the Conscious Navigation session and the accompanying material. Living your life is something only you can do, and how you do so is at your choosing.
While Sessions are personalised and bespoke, the use of the Yourself Ponder Cards is incorporated into each Session, alongside the relevant unique Conscious Navigation tools, approaches, and considerations outlined in full in an accompanying illustrated & informative eBooklet, which will be forwarded via email link, usually within 2 working days.
Your attention is drawn to this notice: As with all the Services offered by us, Conscious Navigation is for informational and educational purposes only. The opinions and ideas are based on personal life experiences, learnings, and intuition, and do not constitute or substitute for medical, health or any other professional service or advice. We encourage you to be proactive in supporting your happiness and wellbeing. To explore, seek, and follow the advice of health and wellbeing professionals, as well as spiritual teachings, self-development and transformational learning, support, and published resources. You are similar to all, but unique; there is no one “answer” - only solutions that are best for you. You must honour what is right for you, and follow the advice of your medical practitioners and other health professionals.
Sessions may be recorded for training and/or to enhance our services with your consent.
he happistuff Huddle is a FREE membership service offered to all customers, clients and giftees, for which you need a happistuff account to access the content (no purchase necessary) and forms a key element of our core offering.
You will receive an email when new content is added, which is usually once a month (or so).
You are invited to complete the huddle “Chirps & Honks” contact form (found in your account) with feedback, comments, insights, or questions related to happistuff and YourSelf products and Services that you wish to ask and share, as often as you like. None of your personal details will be recorded or stored after reading your submissions; however, the underlying point and gist of your communicated content will be noted or summarised for inclusion in the next happistuff huddle update.
The happistuff huddle is a supportive and informative service and, as such, does not include promotional content or offers.
The Just Yours service is completely bespoke, and Terms are agreed on a project-by-project basis.
Wix Payments processes all online payments, and SumUp processes our offline payments.
We accept most major credit and debit cards, including Visa, Mastercard, American Express, as well as Apple Pay and Google Pay.
All payments are in British Pounds Sterling (£/GBP).
You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services.
You agree to pay all charges for your purchases, including any applicable delivery fees, at the prices in effect at the time of purchase, and you authorise us to charge your chosen payment provider for any such amounts when you place your order.
If your order included recurring charges, you agree to us charging your method on a recurring basis without your prior approval for each recurring charge until you cancel the applicable order.
We reserve the right to:
(a) Refuse any order placed through the Services;
(b) Limit or cancel quantities purchased per person, per household, or per order;
(c) Limit or restrict orders placed by or under the same customer account, payment method, or billing or delivery address;
(d) In our sole discretion, limit or prohibit orders that appear to be placed by dealers, resellers, or distributors.
(e) Correct any errors or mistakes in pricing, even if payment has already been requested or received.
(f) Change or amend prices at any time and without notice.
All prices shown are inclusive of VAT.
You agree to keep your account and payment information, including your email addresses, payment method, and payment card expiration date, up to date on a regular and timely basis so that we can complete your transactions and contact you as needed.
We deliver to all areas of the UK via the website. We do not currently ship any physical products internationally.
All delivery time estimates are approximate & may vary. We aim to deliver orders to you as efficiently as possible; however, we are based in an area where logistics can take a little bit longer (as you might be too) & for this reason, we do not offer next-day or similar services.
All orders are personally packed & creatively wrapped with care & heartfelt intention bespoke to the recipient, & are usually processed and dispatched within 7 working days of receipt of your order.
Orders are usually sent via Royal Mail - tracked or tracked with signature required.
Delivery is added at checkout and starts from £4.25. For Individual YourSelf Ponder Cards orders of 4 Cards or fewer, delivery is £5.25, reducing to £4.25 for 5 Cards or more. The YourSelf Ponder Cards Boxed Collection delivery starts at £7.15. Orders valued over £285 are delivered using a Guaranteed Next Day service, starting from £23.00.
Due to the bespoke, hand-finished nature of our Services, if we receive a large number of orders, delivery may be delayed by a few days. Please allow for additional time for transit and delivery.
Backordered items will be sent as soon as they become available.
Multiple-item orders may be sent in separate parcels and arrive separately. If this is the case, your 14-day cancellation period begins when you receive the final package.
Happistuff Ltd shall have no liability to you for any failure to deliver goods or services you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.
PHYSICAL AND DIGITAL PRODUCTS:
Cancellations:
For your items to be eligible for return, they must be in their original packaging, unbroken and unopened, with all original tags, wraps, seals and labels attached, and in the same condition (as new) as when they were sent.
On receipt of your order, you have a 14-day cancellation period during which you can return eligible items at your own cost and risk.
Before returning or cancelling an item, you must email us at you@happistuff.com, including:
(a) Your order number;
(b) The date the order was placed, or the date it was received.
(c) Your full name;
(d) Your full address.
Please note that the original delivery and return postage costs will not be reimbursed.
We recommend you mail your return using a trackable and/or signed-for service.

After we have received and approved your return, we will process your refund and notify you by email when your return has been approved. Please allow at least 14 days from receipt of your item for the processing of your return.
Please note that gifts, bespoke, personalised items, and digital products, including, but not limited to, ePublications and eBooks, cannot be returned.
For Digital products, you will need to waive your cancellation rights via a verification box that will be provided at the point of sale before completing your purchase and downloading the items.
Damaged or defective items:
If your order arrives damaged or defective, you must take photos immediately and send them to us via email at you@happistuff.com within 24 hours. We will contact you on our next working day, or as soon as possible, to arrange a replacement or refund.

SERVICES:
Cancellation of Service Sessions:
Cancellation of in-person, direct, via mobile, electronic means, video and such Service Sessions, including but not limited to Conscious Navigation, requires at least 48 hours' notice. You are required to pay on booking, and have 14 days to cancel and obtain a refund less any cancellation fee due, from your booking or confirmation email, whichever is later, unless the cancellation is made 2 days or less before the booked Service Session, in which case the cancellation period is waived, as the time will have been scheduled, and be difficult to fill at short notice.
You will be notified of any applicable cancellation fees at the time of booking.

As a user of the Services, you agree, directly or indirectly, not to:
(a) Access or use the Services for purposes other than those for which we provide them or in connection with any commercial endeavours unless expressly endorsed or approved by us.
(b) Without written permission, retrieve data or other content from the Services in a systematic manner to create or compile a collection, compilation, database, or directory;
(c) Circumvent, disable, or otherwise interfere with the Services’ security features, including features that prevent or restrict the use of copying of any Content or impose limitations on the use of the Services and/or the Content contained therein;
(d) Defraud, trick, or mislead us, or other users, particularly in any attempt to learn sensitive account information, or use the Services in a way that is inconsistent with any applicable laws or regulations, or that encourages such a breach;
(e) Discredit, tarnish, or otherwise harm us and/or the Services in our opinion;
(f) Inappropriately use our support services or submit false reports of abuse or misconduct;
(g) Harass, abuse, or harm another person using any information obtained from the Services;
(h) Frame or link to the Services without permission;
(i) Upload or transmit (or attempt to upload or transmit) viruses (for this purpose, a ‘virus’ is any programme intentionally introduced into a system that performs a useless and/or destructive function, such as displaying or spamming an annoying message or systematically overwriting the information on a user’s hard disc) that interferes with any party’s uninterrupted use and enjoyment of the Services or modifies, impairs, disrupts, alters, or interferes with the Services;
(j) Use the system in an automated manner, such as by using scripts to send comments, messages, or emails, or by using data mining, robots, or similar data gathering and extraction tools;
(k) Remove any notice or copyright or other proprietary rights from any Content;
(l) Upload, transmit (or attempt to upload or transmit) any material that acts as a passive or active information collection or transmission mechanism, including, but not limited to, clear graphics interchange formats (‘gifs’), 1x1 pixels, web bugs, cookies, or other similar devices (also know as ‘spyware’ or ‘passive collection mechanisms’ or ‘pcms’);
(m) Attempt to circumvent any Service measures intended to prevent or restrict access to the Services or any portion of the Services;
(n) Interfere with, disrupt, or impose an undue burden on the Services or the networks or services to which the Services are linked;
(o) Copy or modify the software used by the Services, including but not limited to Flash, PHP, HTML, JavaScript, or other code;
(p) Except as expressly permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any software comprising or forming a part of the Service;
(q) Except as a result of normal search engine or Internet browser usage, use, launch, develop, or distribute any automated system that accesses the Services, including, but not limited to, any spider, robot, cheat utility, scraper, or offline reader, or use or launch any unauthorised script or other software;
(r) Impersonate another user or person, or use another user’s username;
(s) Harass, annoy, intimidate, or threaten any of our employees or agents who are providing you with any portion of the Services;
(t) Make any unauthorised use of the Services, including collecting user usernames and/or email addresses by electronic or other means for the purpose of sending unsolicited email or creating user accounts by automated means or under false pretences;
(u) Make purchases on the Service through a buy agent or purchasing agent;
(v) Use the Services in any attempt to compete with us, or otherwise use the Services and/or the Content for any revenue-generating endeavour or commercial enterprise.
The Services allow submissions, including but not limited to, the happistuff huddle via the “Chirps & Honks” submission form, happistuff Conscious Navigation, the happistuff Shop, Just Yours, the happistuff Oracle, and our general Contact Form (collectively ‘Contributions’).
We may in the future add to the Contributions and offer further opportunities for you to create, submit, post, transmit, display, publish, perform, broadcast, or distribute content and materials to us or or on the Services, including but not limited to text writing, audio video, graphics, photographs, comments, suggestions, or personal information or other material.
Contributions may be viewed by other Services users and on third-party websites.
By creating or making available any Contributions, you represent and warrant that;
(a) The creation, distribution, transmission, public display, or performance of your Contributions, as well as their access, downloading, or copying, do not and will not infringe any party’s proprietary rights, including but not limited to copyright, patent, trademark, trade secret, or moral rights;
(b) You are the creator and owner, or you have the necessary licences, rights, consents, releases, and permissions to use and authorise us, the Services, and other users of the Services to use your Contributions in any manner contemplated by the Services and these Terms and Conditions;
(c) You have the written consent, release, and/or permission of each and every identifiable person in your Contributions to use their name or likeness to enable inclusion and use of your Contributions in any manner contemplated by the Services and these Terms and Conditions;
(d) Your Contributions do not contain false, inaccurate, or misleading information, nor do they contain unsolicited or unauthorised advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation;
(e) Your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, libellous, slanderous, or otherwise objectionable in our opinion;
(f) Your Contributions do not ridicule, mock, disparage, intimidate, abuse, harass, or threaten (in the legal sense) any other person or group of people, or promote violence against a specific person or group of people.
(g) Your Contributions do not violate any applicable law, regulation, or rule, or any third party’s privacy or publicity rights;
(h) Your Contributions do not violate any applicable law concerning children or minors intended to protect their health and wellbeing;
(i) Your Contributions do not contain any offensive comments about race, national origin, gender, sexual orientation, or physical disability;
(j) Your Contributions do not in any other way violate, or link to material that violates, any provision of these Terms and Conditions or any applicable law or regulation.
We will maintain certain data that you transmit to the Services, as well as data relating to your use of the Services, for the purpose of managing the performance of the Services.
Even though we perform routine data backups, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken while using the Services.
You agree that we will have no liability to you for any loss or corruption of such data, and you agree to waive any right of action against us arising from such loss or corruption.
Any use of the Services in violation of the foregoing violates these Terms and Conditions and may result in the termination or suspension of your rights to use the Services, among other things.
You and Services agree that we may access, store, process, and use any information and personal data you provide, as well as your preferences (including settings).
By providing suggestions or other feedback about the Services, you agree that we may use and share such feedback for any purpose without compensating you.
We do not claim ownership of your Contributions; you retain full ownership of all of your Contributions, as well as any intellectual property rights or other proprietary rights associated with them.
We are not responsible for any statements or representations made in your Contributions in any of the Services.
You are solely responsible for your Contributions or the Services, and you expressly agree to release us from all liability and to refrain from bringing any legal action against us in connection with your Contributions.
We reserve the right, but not the obligation, at our sole discretion to:
(a) Monitor the Services for violations of these Terms and Conditions;
(b) Take appropriate action against anyone who fails to follow the law or these Terms and Conditions, including, but not limited to, notifying law enforcement of the offender;
(c) Reject, deny access, limit in availability, or disable (to the fullest extent technologically feasible) any of your contributions or a portion of them;
(d) Without limitation, notice, or liability, to remove or disable all files and content that are excessive in size or are otherwise burdensome to our systems from the Services;
(e) Otherwise, manage the Services in a way that protects our rights and property while allowing the Services to function properly.

These Terms and Conditions are governed by Scottish law, and all disputes are subject to the exclusive jurisdiction of the courts of Scotland.
These Terms and Conditions contain the entire agreement between you and Happistuff Limited relating to their subject matter.
Visiting the Services, sending us emails, and completing online forms are all examples of electronic communications.
You consent to receiving communications from us electronically and acknowledge that all agreements, notices, disclosures, and other information that we provide to you electronically via email and through the Services satisfy any legal requirement that such communications be in writing.
You consent to use electronic signatures, contracts, orders, and other records, as well as electronic delivery notices, policies, and records of transactions initiated or completed by us or through the Services.
You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction that require an original signature, delivery, or retention of non-electronic records, or payments or credit granting by any means other than electronic means.
These Terms and Conditions will remain in full force and effect while you use the Services.
Without limiting any other clause in these Terms and Conditions, we reserve the right to refuse access to and use of the Services (including blocking particular IP addresses) to anyone for any reason or no reason, including but not limited to infringement of any representation, warranty, or agreement found in these Terms and Conditions or of any applicable law or regulation.
In our sole discretion, we may terminate your use or participation in the Services, or delete your account and any content or information that you posted at any time and without notice.
You are not allowed to register and open a new account in our name, a fictitious name, a name you borrowed, or the name of any third party, even if you may be acting on their behalf, if we terminate or suspend your account for any reason.
In addition to terminating or suspending your account, we reserve the right to pursue appropriate legal action, including civil, criminal, and injunctive redress.

Even if we have been informed of the possibility of such damages, Happistuff Limited and/or our directors, employees, or agents will never to liable to you or any third party for any direct, indirect, consequential, exceptional, inadvertent, unique, or punitive damages, which would include lost profit, lost revenue, loss of data, or other damages whatsoever resulting from your use of the Services.
